THE METROPOLITAN BOROUGH OF BURY (VARIOUS SITES GARSIDE HEY ROAD AREA EMERGENCY ACTIVE TRAVEL SCHEME BURY) (PROHIBITION OF DRIVING) EXPERIMENTAL ORDER 2020 NOTICE IS HEREBY GIVEN that Bury Metropolitan Borough Council has made the above named experimental order on 09/11/20 under S9 and S10 of the Road Traffic Regulation Act 1984 as amended which comes in to force on 27/11/20 for a period not exceeding 18 months the effect of the Order will be as follows: To introduce a prohibition of driving (except for cyclists) at the following locations:
NOTICE IS HEREBY GIVEN that Bury Metropolitan Borough Council has made the above named experimental order on 09/11/20 under S9 and S10 of the Road Traffic Regulation Act 1984 as amended which comes in to force on 27/11/20 for a period not exceeding 18 months the effect of the Order will be as follows: To introduce a prohibition of driving (except for cyclists) at the following locations:
i) Toon Crescent - for a distance of 5m in a southerly direction from its junction with Birks Dr
ii) Birks Drive - for a distance of 5m in a northerly direction from its junction with Garside Hey Rd
iii) Holme Avenue - for a distance of 5m in a southerly direction from its junction with Garside Hey Rd
iv) Collen Crescent - for a distance of 5m in a northerly direction from its junction with Garside Hey Rd
v) Boulden Drive - Bury - for a distance of 25m in a south westerly direction from its junction with Holme Ave
The Council has also introduced a 'humped' zebra crossing 50m east of Birks Dr
A copy of the experimental order as made, plans showing the locations of the measures proposed and a statement of the Council's reasons for making the proposals may be requested by email at
quoting ref TM2/20/487 for the proposed prohibition of driving locations and PC/94 for the 'humped* zebra crossing.
The Council will be considering in due course whether the provisions of the experimental Order should be continued in force indefinitely. Any person wishing to object to such mdefinite continuation of the provisions may within 6 months of 19/11/20 (or if this Order is varied by another Order or modified pursuant to section 10(2) of the Act, 6 months from the on which the variation or modification or the latest variation or modification came into force) object in writing stating the grounds on which that objection is being made. Objections should be sent to the Head of Engineering, 3 Knowsley Place, Duke street, Bury BL9 0EJ or preferably by email to
quoting ref TM2/20/487 regarding the prohibition of driving.
Regarding the 'humped' zebra crossing, objections or representations should be sent by 18/11/20 quoting ref PC/94. Pease note that all representations received may be considered in public by the Council and that the substance of any representation together with the name and address of the person making it could become available for public inspection.
Any person who wishes to question the validity of the experimental Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Act, or that any requirements of the Act or of any instrument made under it have not been complied with may, within 6 weeks from the date on which the Order was made, apply to the High Court for that purpose.
