A CONTROVERSIAL new petrol station will be built in Shaw as the council’s decision to refuse planning permission has been overturned after an appeal.

The contentious plans to erect a filling station on a section of car park at the Asda store off Greenfield Lane had been rejected over concerns about potential congestion and noise.

The loss of existing recycling facilities on the proposed petrol station site was also considered "unacceptable", according to the decision notice issued after the hearing in December, 2017.

However, a government appointed planning inspector has now ruled the plans can go ahead, provided a number of conditions are met.

These include the stipulation that the development cannot become operational until the junction with Greenfield Lane has been widened in the interest of highway safety.

And a replacement recycling facility should be provided elsewhere on the site.

The station would have eight filling points and a one-way system for vehicles in addition to new lighting, CCTV and a payment kiosk.

The proposal would reduce the total number of car parking spaces on the car park from around 316 to 280.

Addressing concerns raised by residents and local councillors, Inspector Mike Worden said: “I have no evidence to indicate that the proposal would present an unacceptable risk to health and safety or would lead to unsocial behaviour.

“I conclude that the proposed development would not cause harm to the living conditions of the occupants of neighbouring properties with particular regard to noise.”

Responding to the ruling, Shaw ward councillor Chris Gloster said: “Having spoken to local residents to inform them of the news, they are bitterly disappointed and believe that this development will undoubtedly affect their quality of life being only some 13 metres away from their homes.

“The communities of Shaw and Crompton were always divided on this application, whereas some welcomed the likelihood of cheaper fuel, others recognised the detrimental effect to the neighbours and road system, as well as increased congestion at peak times.

“Although Shaw ward councillors are disappointed at the outcome of the appeal, they are pleased that the Inspector has retained and increased the planning conditions imposed upon Asda before the development can begin.”
