THE trial of an Oldham man charged with murdering a 60-year-old in Derker has continued.

Jamie Kennedy, 24, has pleaded guilty to manslaughter but denies the murder of Robert Payne following a disturbance on Frances Street.

On the morning of October 15 last year, the defendant, of Garden Terrace, Royton, punched Mr Payne, causing him to fall to the floor and hit his head.

Mr Payne, who was known as Bob, died in hospital three days later due to brain injuries.

Shaunnagh Roberts, a neighbour of Mr Payne's, had joined the group of people drinking at the deceased's address and said "all the men were drunk".

In an extract of a pre-recorded video taken when Ms Roberts spoke to police on November 4 last year, she said on a scale of one to 10 in terms of drunkenness, Kennedy was a 10.

Speaking at Manchester Crown Court, she said: "Jamie was that drunk I don't even think he knew what he [was] doing."

Kennedy had a relationship with Mr Payne, who he referred to as 'Uncle Bob', and would sometimes visit the address on Frances Street.

Ms Roberts confirmed that an altercation had occurred between Kennedy and Mr Payne in the latter's home.

The disturbance then spilled out into the front garden at around 9am, with Ms Roberts saying Mr Payne was trying to get Kennedy to leave the premises.

Another neighbour, Megan Taylor, said she was awoken by the noise of shouting and rang the police.

She described seeing Kennedy hit Mr Payne, causing him to fall to the ground before he leaned over Mr Payne and punched him "three or four" more times.

Both Ms Roberts and Ms Taylor said Kennedy tried to stamp on an unconscious Mr Payne after the punches were landed but he was stopped by Ms Roberts.

Ms Taylor said Kennedy "tried to kick" Mr Payne while he was on the floor and had the impression he was going to stamp on him.

She said: "Shauna stopped him from stamping on [Mr Payne]. She pushed him away and said 'don't do it.'"
